1. About Auralign & Scope
Auralign is a brand of Swiss OrthoPlan by Hobeanu, Switzerland (“Swiss OrthoPlan”). Swiss OrthoPlan is the contractual partner for all services and products offered under the Auralign brand.
These Terms & Conditions apply to the business relationship between Swiss OrthoPlan and dental practices, dentists, orthodontists and other authorised dental professionals using Auralign products or services (“Dental Professionals”).
They apply to services provided in connection with Auralign, including digital treatment planning, case-related services, manufacturing and supply of clear aligners, as applicable.
By placing an order or using Auralign services, the Dental Professional accepts these Terms & Conditions.
2. Our Services
Swiss OrthoPlan provides digital orthodontic and manufacturing services under the Auralign brand for Dental Professionals.
Depending on the selected service and individual case, Auralign services may include digital treatment planning, creation of 3D treatment setups, preparation of production data, manufacturing of clear aligners and related case support.
The scope of each case is determined by the service selected by the Dental Professional and the corresponding order or individual agreement.
Auralign provides technical, digital planning and manufacturing services. Diagnosis, treatment indication, prescription, approval of the treatment plan and all clinical decisions remain the responsibility of the treating Dental Professional.
3. Orders & Case Acceptance
Orders for Auralign services are submitted by the Dental Professional through the designated ordering process or other communication channels accepted by Swiss OrthoPlan.
The Dental Professional is responsible for providing complete and accurate information required for the case, including the necessary clinical instructions, digital scans, files and other case-related information.
Swiss OrthoPlan may review the submitted information before accepting or processing a case. If information or files are incomplete, technically unsuitable or insufficient for treatment planning or manufacturing, additional information or new files may be requested.
Submission of a case does not automatically guarantee acceptance. Swiss OrthoPlan reserves the right to decline a case where the requested service cannot reasonably or technically be provided.
A case is considered accepted once Swiss OrthoPlan confirms the order or begins processing the case.
4. Digital Treatment Planning
Where digital treatment planning is included in the selected service, Auralign prepares a digital treatment setup based on the information, instructions and records provided by the Dental Professional.
The digital treatment setup represents a proposed treatment sequence and is provided to the Dental Professional for review. The Dental Professional is responsible for assessing the setup from a clinical perspective and determining whether it is appropriate for the individual patient.
The Dental Professional may request reasonable modifications to the proposed setup before final approval.
Manufacturing of the aligners will begin only after the Dental Professional has approved the final treatment setup.
By approving the treatment setup, the Dental Professional confirms that the planned tooth movements, treatment objectives and relevant clinical parameters have been reviewed and accepted.
Auralign does not replace the Dental Professional's clinical judgement. The treating Dental Professional remains responsible for diagnosis, treatment indication, patient suitability, clinical monitoring and any adjustments required during treatment.
5. Responsibilities of the Dental Professional
The Dental Professional is responsible for the diagnosis, treatment indication and clinical management of each patient treated with Auralign.
Before submitting a case, the Dental Professional must assess whether the patient is suitable for clear aligner treatment and ensure that all necessary clinical examinations and diagnostic procedures have been performed.
The Dental Professional is responsible for providing accurate and sufficiently detailed case information, including high-quality digital scans or impressions, treatment instructions and any other records required for treatment planning and manufacturing.
The Dental Professional is also responsible for reviewing and approving the proposed digital treatment setup before manufacturing begins.
All clinical procedures required during treatment, including the placement of attachments, interproximal reduction (IPR), extractions or other procedures indicated in the approved treatment plan, remain the responsibility of the treating Dental Professional.
The Dental Professional is responsible for providing the patient with appropriate instructions regarding the use, wear and care of the aligners and for monitoring treatment progress through appropriate clinical follow-up.
If the clinical situation changes, treatment does not progress as expected, or the aligners no longer fit appropriately, the Dental Professional must assess the patient before continuing treatment and, where appropriate, contact Auralign for further case support.
The Dental Professional is responsible for obtaining any patient information, consent or authorisation required for treatment and for the lawful transmission of patient data and clinical records to Swiss OrthoPlan.
6. Manufacturing & Aligner Delivery
Following approval of the final treatment setup by the Dental Professional, the aligners are manufactured according to the approved digital treatment plan and the specifications applicable to the selected Auralign service.
The number and sequence of aligners supplied are determined by the approved treatment setup and the corresponding order.
Auralign takes appropriate measures to ensure that the aligners are manufactured consistently and in accordance with the approved production data.
Minor variations in appearance, surface characteristics, transparency, trimming or other manufacturing-related characteristics may occur and do not constitute a defect where they do not materially affect the intended fit, function or safe use of the aligner.
Upon receipt, the Dental Professional should verify that the delivered aligners correspond to the relevant case and should inspect them for visible damage or apparent manufacturing defects before providing them to the patient.
Any apparent defect, damage or discrepancy should be reported to Auralign as soon as reasonably possible after discovery.
Delivery times communicated by Auralign are estimates unless a delivery date has been expressly confirmed as binding.
7. Changes, Refinements & Additional Aligners
Changes requested before final approval of the digital treatment setup will be handled as part of the treatment planning process, subject to the scope of the selected Auralign service.
After the treatment setup has been approved and manufacturing has begun, subsequent changes to the treatment plan may require a new setup, new scans and/or the manufacture of additional aligners.
If treatment does not progress according to the approved setup, the Dental Professional must clinically reassess the patient and provide any updated records required by Auralign before a refinement or additional aligners can be planned.
Refinements, replacement aligners, additional aligners or treatment extensions are not automatically included in the original order unless expressly included in the selected Auralign package or otherwise agreed with Swiss OrthoPlan.
Any additional costs will be communicated to the Dental Professional before the corresponding additional service or manufacturing process is initiated.
Auralign cannot guarantee that the clinically achieved treatment result will correspond exactly to the digital treatment simulation, as individual biological response, patient compliance and other clinical factors may influence treatment progress and outcome.
8. Prices & Payment
The prices applicable to Auralign products and services are those communicated to the Dental Professional at the time of ordering or as set out in the applicable offer, price list or individual agreement.
Unless otherwise stated, prices are quoted in Swiss francs (CHF). Any applicable taxes, shipping costs or additional charges will be indicated separately where relevant.
Invoices are issued by Swiss OrthoPlan by Hobeanu, as the contractual partner for products and services provided under the Auralign brand.
Payment must be made within the payment period stated on the respective invoice.
Additional services requested by the Dental Professional that are not included in the original order, such as additional treatment planning, refinements, replacement aligners or treatment extensions, may be charged separately. Any applicable additional costs will be communicated before the corresponding service is initiated.
In the event of overdue payment, Swiss OrthoPlan reserves the right, after appropriate notice, to suspend the processing of new orders or further services until outstanding amounts have been settled.
Any objections regarding an invoice should be communicated to Swiss OrthoPlan within a reasonable period after receipt.
9. Shipping & Delivery
Auralign products are delivered to the address provided by the Dental Professional during the ordering process or otherwise communicated to Swiss OrthoPlan.
The Dental Professional is responsible for ensuring that the delivery address and contact information provided are complete and accurate.
Shipping costs, where applicable, will be communicated as part of the order, offer or applicable price conditions.
Any delivery times communicated by Auralign are estimates unless expressly confirmed as binding. Delays may occur due to production requirements, transport providers, customs procedures, supply disruptions or other circumstances outside the reasonable control of Swiss OrthoPlan.
Swiss OrthoPlan is not responsible for delays caused by incorrect or incomplete delivery information provided by the Dental Professional or by circumstances outside its reasonable control.
Upon receipt, the Dental Professional should inspect the shipment for visible transport damage, missing items or other apparent discrepancies and notify Auralign as soon as reasonably possible.
If a shipment appears to have been lost or materially damaged during transport, the Dental Professional should contact Auralign promptly so that the circumstances can be investigated with the relevant shipping provider.
10. Quality, Defects & Complaints
Auralign aims to provide products that meet the applicable quality requirements and correspond to the approved digital treatment setup and production data.
The Dental Professional should inspect the aligners before providing them to the patient. Any apparent manufacturing defect, incorrect product, damage or other discrepancy should be reported to Auralign as soon as reasonably possible after discovery.
When reporting a suspected defect, Auralign may request photographs, case information, digital scans or other information reasonably necessary to assess the issue.
If Auralign confirms that an aligner is defective due to a manufacturing or processing error attributable to Swiss OrthoPlan, the affected product will, where appropriate, be replaced or otherwise corrected without additional manufacturing charge.
A difference between the planned tooth position and the clinically achieved tooth position does not, by itself, constitute a manufacturing defect. Treatment progression may be influenced by biological response, patient compliance, clinical procedures, the accuracy of submitted records and other patient-specific factors.
Problems resulting from inaccurate or incomplete scans, impressions, case information or instructions supplied by the Dental Professional are not considered manufacturing defects attributable to Auralign.
Nothing in this section limits any rights or obligations that cannot legally be excluded under applicable law.
11. Patient Data & Confidentiality
For the provision of Auralign services, the Dental Professional may provide Swiss OrthoPlan with patient-related information and clinical records required for digital treatment planning, manufacturing and case management.
Such information may include digital dental scans, STL files, photographs, treatment instructions and other clinical information necessary to process the case.
The Dental Professional is responsible for ensuring that patient data is collected and transmitted lawfully and that any information, consent or authorisation required under applicable data protection and professional confidentiality requirements has been obtained.
Swiss OrthoPlan will process patient-related data only to the extent necessary to provide the requested Auralign services, manage the relevant case, comply with applicable legal obligations and maintain the security and integrity of its services.
Swiss OrthoPlan will take appropriate technical and organisational measures to protect patient and clinical data against unauthorised access, disclosure, alteration, loss or misuse.
Where third-party technical or production partners are required to provide Auralign services, relevant data may be made available to such partners only to the extent necessary for the performance of their respective services and subject to appropriate confidentiality and data protection requirements.
Patient and clinical information will be treated confidentially and will not be sold or used for unrelated commercial purposes.

12. Intellectual Property & Digital Files
The Auralign name, logo, website content, designs, documentation and other brand materials are owned by or licensed to Swiss OrthoPlan and may not be reproduced, modified or used for commercial purposes without prior permission.
Patient records, clinical information and original digital files submitted by the Dental Professional remain attributable to the Dental Professional and/or patient, as applicable.
Digital treatment setups, visualisations, production data and other materials created as part of the Auralign service may be provided to the Dental Professional for the purpose of reviewing, approving and carrying out the relevant patient's treatment.
Unless otherwise agreed, such materials may not be resold, commercially distributed, modified for use with another aligner system, or made available to third parties for unrelated commercial purposes.
Swiss OrthoPlan may retain case-related digital files and documentation where reasonably necessary for case management, quality assurance, traceability, legal compliance and the provision of subsequent case support, subject to applicable data protection requirements.
Nothing in these Terms transfers ownership of the Auralign brand, proprietary workflows, software, production methods or other intellectual property of Swiss OrthoPlan or its technology partners to the Dental Professional.
13. Liability
Swiss OrthoPlan is responsible for the proper performance of the services provided under the Auralign brand in accordance with the agreed scope of the relevant order.
The Dental Professional remains responsible for all clinical decisions, including diagnosis, patient selection, treatment indication, approval of the treatment setup, clinical procedures and ongoing monitoring of the patient.
Auralign does not guarantee a specific clinical treatment outcome. The actual course and result of treatment may differ from the digital treatment setup due to individual biological response, patient compliance, clinical conditions and other factors outside the reasonable control of Swiss OrthoPlan.
Swiss OrthoPlan is not responsible for loss or damage resulting from incorrect, incomplete or unsuitable information, scans, records or instructions provided by the Dental Professional, or from use of the Auralign products contrary to the approved treatment plan or applicable instructions.
To the extent permitted by applicable law, Swiss OrthoPlan shall not be liable for indirect or consequential losses arising from the use of Auralign products or services.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted under applicable Swiss law.
14. Term & Termination
Unless otherwise agreed, Auralign services are provided on a case-by-case basis. Each accepted order constitutes an individual service relationship between Swiss OrthoPlan and the Dental Professional.
The Dental Professional may request cancellation of a case before manufacturing has begun. Any services already performed, including digital treatment planning or other case-related work, may remain chargeable.
Once manufacturing has begun, cancellation may no longer be possible and Swiss OrthoPlan reserves the right to charge for costs and services already incurred.
Swiss OrthoPlan may suspend or discontinue services where the Dental Professional has materially breached these Terms, has outstanding payment obligations, has provided insufficient or inappropriate information required to safely process a case, or where continuation of the service would not reasonably be possible.
Termination or cancellation of an order does not affect payment obligations or other rights and obligations that arose before the termination or cancellation.
15. Changes to These Terms
Swiss OrthoPlan reserves the right to update or amend these Terms & Conditions where necessary, including in response to changes in Auralign services, business processes, technical requirements or applicable law.
The current version of the Terms & Conditions will be published on the Auralign website.
For orders already accepted, the version of the Terms & Conditions applicable at the time of the order will generally remain applicable, unless a change is required by law or otherwise agreed with the Dental Professional.
16. Applicable Law & Jurisdiction
These Terms & Conditions and all contractual relationships relating to Auralign products and services are governed by Swiss law.
The parties will endeavour to resolve any disagreement arising from an Auralign order or service amicably and in good faith.
Subject to any mandatory jurisdiction provided by applicable law, the courts at the registered place of business of Swiss OrthoPlan shall have jurisdiction over disputes arising from or relating to these Terms & Conditions or Auralign products and services.
Mandatory provisions of applicable law remain unaffected.
